Welcome to CommuterCash.com. CommuterCash, Inc. provides CommuterCash.com website features to you subject to the following conditions. If you visit or register at CommuterCash.com, you accept these conditions. Please read them carefully.

1. ACCEPTING THE TERMS

In order to use CommuterCash.com, you must first agree to the Terms of Service. You may not use the Services if you do not accept the Terms.

You can accept the Terms by:

(A) clicking to accept or agree to the Terms, where this option is made available to you by CommuterCash, Inc. in the registration interface for any Service; or

(B) by actually using the Services. In this case, you understand and agree that CommuterCash, Inc. will treat your use of the Services as acceptance of the Terms from that point onwards.

You may not use the Services and may not accept the Terms if (a) you are not 18 years of age, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are resident or from which you use the Services.

2. PRIVACY

Please review our Privacy Notice, which also governs your use of CommuterCash.com, to understand our practices.

3. ELECTRONIC COMMUNICATIONS

When you visit CommuterCash.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

4. COPYRIGHT

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of CommuterCash, Inc. or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of CommuterCash, Inc. and protected by U.S. and international copyright laws. All software used on this site is the property of CommuterCash, Inc. or its software suppliers and protected by United States and international copyright laws.

5. USE OF THE SERVICES

CommuterCash, Inc.'s Services are based on its attempt to match up site registrants ("Commuters”) with businesses ("Advertisers”) who would be interested in paying Commuters for placing advertising on their vehicles during their drives to work. CommuterCash, Inc. is not responsible for any contract or agreement, verbal or written, between a Commuter and an Advertiser. CommuterCash, Inc.'s role is limited to that of an intermediate party attempting to facilitate a suitable association between a Commuter and an Advertiser. IN PARTICULAR, COMMUTERCASH, INC. DOES NOT REPRESENT OR WARRANT TO YOU THAT YOUR USE OF THE SERVICES WILL RESULT IN A MATCH BETWEEN COMMUTER AND ADVERTISER.

In order to access certain Services, you may be required to provide information about yourself (such as identification, contact details, or details about your commute [for Commuters] or business [for Advertisers] as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to CommuterCash, Inc. will be accurate and current.

You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries).

You agree not to access (or attempt to access) any of the Services by any means other than through the CommuterCash.com interface. You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).

You agree that you are solely responsible for any breach of your obligations under the Terms and for the consequences of any such breach.

6. YOUR ACCOUNT AND SECURITY

If you use CommuterCash.com, you are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password. If you become aware of any unauthorized use of your password or of your account, you agree to notify CommuterCash, Inc. immediately. If you are under 18, you may not use CommuterCash.com. CommuterCash, Inc. reserves the right to refuse service, terminate accounts, remove or edit content, or cancel registration in their sole discretion.

7. PRICING AND REFUND POLICY.

The List Price displayed for Commuter registration on CommuterCash.com represents the extent of all fees for registration. Registration is a one-time-only fee and is NONREFUNDABLE. If a user closes or inactivates his or her account, and at a future time wishes to use CommuterCash.com services again, he or she must re-register and pay the fee again.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

COMMUTERCASH, INC. DOES NOT WARRANT OR OTHERWISE GUARANTEE THAT INDIVIDUALS WHO REGISTER ON THE SITE WILL EVER, AT ANY TIME, BE CONTACTED BY AN ADVERTISER FOR THE PURPOSE OF PLACING ADVERTISING MATERIAL ON HIS OR HER VEHICLE. Making an offer is at the sole discretion of an Advertiser.

COMMUTERCASH, INC. DOES NOT WARRANT OR GUARANTEE THAT A COMMUTER WHO HAS REGISTERED ON THE SITE WILL ACCEPT AN ADVERTISER'S PROPOSAL OR TERMS FOR PLACING ADVERTISING MATERIAL ON HIS OR HER VEHICLE. Accepting an offer is at the sole discretion of a Commuter.

COMMUTERCASH, INC. DOES NOT WARRANT OR GUARANTEE THAT A COMMUTER WHO HAS ACCEPTED AN ADVERTISER'S PROPOSAL OR TERMS FOR PLACING ADVERTISING MATERIAL ON HIS OR HER VEHICLE WILL CARRY OUT THE TERMS OF HIS OR HER AGREEMENT WITH THE ADVERTISER. Any agreement for the Commuter to carry advertising on his or her vehicle is a separate agreement between the Commuter and Advertiser and is not subject to CommuterCash, Inc. Terms of Service.

COMMUTERCASH, INC. IS NOT RESPONSIBLE FOR ANY DAMAGES INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, TO ANY VEHICLE OR ANY DRIVER CAUSED BY AN ADVERTISEMENT PLACED ON A COMMUTER'S VEHICLE AS A RESULT OF A MATCH FACILITATED BY COMMUTERCASH, INC.

COMMUTERS ARE RESPONSIBLE FOR CHECKING WITH THEIR CAR INSURANCE COMPANIES TO ENSURE THAT CARRYING AN ADVERTISER'S ADVERTISEMENT ON THEIR MOTOR VEHICLE WILL NOT VIOLATE THE TERMS OF THEIR INSURANCE.

This site and all information, content, materials, products and services included on or otherwise made available to you through CommuterCash.com are provided on an "as is" and "as available" basis. CommuterCash, Inc. makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, products or services included on or otherwise made available to you through this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, CommuterCash, Inc. disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. CommuterCash, Inc. does not warrant that this site; information, content, materials, products or services included on or otherwise made available to you through this site; their servers; or e-mail sent from CommuterCash, Inc. are free of viruses or other harmful components. CommuterCash, Inc. will not be liable for any damages of any kind arising from the use of this site or from any information, content, materials, products or services included on or otherwise made available to you through this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

9. ENDING THE RELATIONSHIP UNDER THESE TERMS OF SERVICE

The Terms of Service will continue to apply until terminated by either you or CommuterCash, Inc. as set out below.

If you want to terminate your registration with CommuterCash, Inc., you may do so by (a) notifying CommuterCash, Inc. at any time and (b) closing your accounts for all of the Services which you use, where CommuterCash, Inc. has made this option available to you. Your notice should be sent, in writing, to CommuterCash, Inc.'s address which is set out at the bottom of these Terms.

CommuterCash, Inc. may at any time, terminate its agreement with you if:

(A) you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or

(B) CommuterCash, Inc. is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or

(C) CommuterCash, Inc. is transitioning to no longer providing the Services to users in the area in which you are resident or from which you use the service; or

(D) the provision of the Services to you by CommuterCash, Inc. is, in CommuterCash, Inc.'s opinion, no longer commercially viable.

NO REFUNDS OF FEES OR DAMAGES WILL BE AWARDED AS A RESULT OF TERMINATION, REGARDLESS OF WHICH PARTY TERMINATES THIS AGREEMENT.

10. APPLICABLE LAW

By visiting CommuterCash.com, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and CommuterCash.com

11. DISPUTES

Any dispute relating in any way to your visit to CommuterCash.com or to products or services sold by CommuterCash, Inc. shall be adjudicated in any state or federal court in Ventura County, California, and you consent to exclusive jurisdiction and venue in such courts.

12. SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our privacy policy, posted on this site. These policies also govern your visit to CommuterCash.com. We reserve the right to make changes to our site, policies, and these Terms of Use at any time. When these changes are made, CommuterCash, Inc. will make a new, updated copy of the Terms of Service available at http://www.commutercash.com/termsofservice.html. You understand and agree that if you use the Services after the date on which the Terms of Service have changed, CommuterCash, Inc. will treat your use as acceptance of the updated Terms of Service.

If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
